The following terms and conditions do not affect your statutory rights as a consumer.

Contract

Acceptance of an order by Maxbal Genealogy in writing to the address given by you or by email to the email address given by you on an order or receipt of payment by Maxbal Genealogy for goods purchased from our web site shall form the contract between you and Maxbal Genealogy and these terms and conditions will apply to the contract.

The contract between Maxbal Genealogy and you is subject to the laws of England

Prices

Prices for non-custom designed items are detailed on our web site and price lists which are available on request.

On receipt of an enquiry for custom designed products and/or services Maxbal Genealogy will issue a quotation which will show the price and details of the product and/or service. The quotation is available for acceptance by you for a period of 30 days from issue. Maxbal Genealogy reserves the right to amend the quoted price should changes requested by you in the design of products result in a change to the printed size or quantity and in the case of services result in a change to the time required to provide those services. Maxbal Genealogy will inform you of any such price change before carrying out the changes.

Shipping/Postage Charges

Shipping/postage charges will be added to all orders.

The cost for shipping/postage is based on the value of your order and postage zone where goods are to be dispatched.

You will be notified of the shipping/postage costs before confirming your order and making payment.

Shipments To Destinations Other Than The UK

Each country may have variable taxes and duties levied depending on the product.

You are responsible for these additional taxes.

Some countries may also charge VAT (Value Added Tax).

You should ensure that you are aware of the import tax, and VAT in your country as you will be liable for the cost of return shipping of your purchase if you refuse to pay the tax on your shipment.

Proofs

Maxbal Genealogy will provide you with a pre-production proof of your custom designed genealogy charts and books. The proof will be in pdf format. The proof will be sent by email to the email address given by you on the order form. The copyright of the proof is owned by Maxbal Genealogy and the proof will contain a watermark which must not be removed.

Terms of Payment

All goods must be paid for in full before dispatch. Goods will not be dispatched until Maxbal Genealogy is in receipt of cleared funds and will normally be dispatched within seven working days.

Payment can be made by credit or debit card through the secure payment system on our web site or by cheque or money order made payable to Maxbal Genealogy. Our secure payment system is managed by PayPal.

When paying by eCheque through PayPal it will take 5 to 7 working days for your eCheque to clear.

Information Supplied By You

You are responsible for the accuracy of the information that you supply to us. Maxbal Genealogy reserves the right to make additional charges for making any changes to data supplied by you where you request such changes. Maxbal Genealogy will inform you of any such additional charges before making changes.

Confidential Information

Maxbal Genealogy will treat all information, documents, photographs and records submitted by you as confidential and will not share, loan, or disclose their contents to any third party without your written permission. Nor will Maxbal Genealogy exhibit the documents or display them on its web site without your written permission.

Copyright

You warrant that you own the copyright to all documents, graphics or photographs that are to be reproduced or that you have obtained permission from the copyright holder to allow the documents, graphics or photographs to be reproduced.

Maxbal Genealogy acknowledges that you or others own the copyright to any document that you supply to us where the document or documents are not in the public domain.

Our products are protected by copyright. You acknowledge that the copyright to genealogy charts designed and/or supplied by Maxbal Genealogy is owned by Maxbal Genealogy. You must not make copies of any of the Maxbal Genealogy family tree charts, research forms or any other product or any part of a product.

We always prosecute to the full extent of the law when we identify a breech of our copyright.

Your Right To Cancel

You have the right to cancel your order with us as follows: -

1. for custom designed genealogy charts and products at any time before you confirm the final design.

2. for non custom designed products within a period of seven working days after you receive them.

3. for graphics supplied in electronic format at any time before we dispatch your order.

4. for services at any time.

If you decide to cancel you must send an email to sales@maxbal.co.uk telling us that you wish to cancel your order.

In the event of cancellation you will be entitled to a full refund for any monies paid against cancelled products and the unused portion of payments made against services.

You are responsible for the cost of returning any cancelled goods to Maxbal Genealogy.

Goods must be returned undamaged and in their original packaging. If goods are returned damaged or not in their original packaging we reserve the right to deduct reasonable costs from the refund amount to make the goods fit for sale.

We will refund you within 30 days of receiving the cancelled goods.
